The Issue
A caller to the EASS Helpline made a flexible working request while on maternity leave that was declined. She wanted to change her hours to look after her third child. The employer refused the flexible working request which was subsequently refused at an appeal hearing.
The client also suffers from anxiety and depression and her employer wanted to move her to another department, she was the only one being moved and she didn’t know why. This all happened while she was still on maternity leave. The client genuinely felt that had she been at work, she wouldn’t have been moved departments, as her Doctor had said it’s best to stay where she is, as a reasonable adjustment for her mental health.

Because the caller had exhausted all her employer’s internal processes, she attempted conciliation and later took her complaint based on our advice to an Employment Tribunal. The judge ruled that Pregnancy and Maternity Discrimination had occurred and awarded in favour of the individual. We were delighted to receive a call from the individual advising us that the case had been successfully resolved at tribunal.
